Terms of Service
Welcome to Hell's Kitchen Pickleball Club (“Hell's Kitchen Pickleball,” “We,” “Us,” or “Our”). These Terms of Service (“Terms”) govern your access to and use of our facilities, services, website, and programming. By using any of our services, you agree to abide by these Terms. If you do not agree with any part of the Terms, you may not use our services.
1. Acceptance of Terms
By accessing or using any portion of our services—including booking courts, participating in events, or visiting our website—you agree to be legally bound by these Terms. These Terms apply to all users, including members, guests, and participants in clinics, leagues, or tournaments.
2. Eligibility
You must be at least 18 years old or have the express consent of a parent or legal guardian to use our services. By using our services, you affirm that you meet this requirement.
3. Memberships and Fees
All memberships, bookings, and programming are subject to fees as listed on our website or disclosed at the facility. All payments are non-refundable unless otherwise stated in writing. We reserve the right to adjust pricing with reasonable notice.
4. Facility Rules and Code of Conduct
All players and guests must follow Hell's Kitchen Pickleball Club rules, which include but are not limited to:

Abiding by safety instructions from coaches and staff

Maintaining sportsmanship and inclusive conduct at all times
Violations of these rules may result in removal from the facility or suspension of services, without refund.
5. Booking Policies
Court reservations must be made using our official booking platform. All bookings are subject to availability. Cancellation and rescheduling policies are listed on our website and must be followed to avoid penalties.
6. Liability Waiver
By entering the facility or participating in any activity, you voluntarily assume all risks related to physical activity and release Hell's Kitchen Pickleball Club from liability for any injury or loss. A signed waiver is required for all participants.
7. Privacy Policy
Your use of our services is also governed by our Privacy Policy, which outlines how your personal information is collected, used, and stored.
8. Intellectual Property
All content found on our website or displayed in the facility—including logos, text, media, designs, and software—is owned by Hell's Kitchen Pickleball Club or its licensors. You may not copy, reuse, or redistribute any content without written permission.
9. Third-Party Services
We may use third-party platforms (e.g., Podplay) for functions such as court booking, registration, and communication. Your use of these services is also subject to the terms and privacy policies of those platforms.
10. Cancellations and Refunds
Refund eligibility for memberships, events, leagues, or court reservations will follow the policies detailed on our website or at the point of purchase. Refunds will only be granted under the terms of those policies.
11. Termination of Services
We reserve the right to suspend or terminate your access to any service at our discretion, particularly if you violate these Terms or behave in a way that disrupts the community experience.
12. Force Majeure
Hell's Kitchen Pickleball Club is not liable for delays or service disruptions caused by events outside of our control, including natural disasters, utility outages, or government restrictions.
13. Dispute Resolution
Any disputes arising out of or relating to your use of our services will be governed by the laws of New York State and resolved through binding arbitration, waiving the right to pursue claims in court.
14. Changes to Terms
We may revise these Terms at any time. Updates will be posted on our website and become effective immediately upon posting. Continued use of our services indicates your acceptance of the revised Terms.
